Bankruptcy FAQ

What Debts Can I Discharge?

Clients in Alexandria and throughout central Louisiana turn to the McBride Law Firm because they know we put their interests first. Our attorneys don’t recommend bankruptcy unless it is the best way to eliminate debt based off each client’s individual goals, debts and assets. We carefully evaluate each of your debts to determine whether it is dischargeable through bankruptcy.

What Debts Can I Discharge Through Bankruptcy?

Most debts are dischargeable through bankruptcy. Common types of dischargeable debt include:

  • Credit card debt
  • Car loans
  • Certain tax debts
  • Medical debts
  • Mortgages
  • Past-due rent
  • Past-due utility payments
  • Deficiency judgments

Even After Repossession Or Foreclosure You Could Owe

Just because you forfeited a car to repossession or lost your home to foreclosure does not mean you aren’t responsible for the loan you took out to purchase those items. When cars and other properties are repossessed and homes are foreclosed upon, they are often sold at auction. If the auction price is less than the balance of the loan, you can be held liable for the difference, or the “deficiency.” Creditors can obtain “deficiency judgments” and pursue collections actions — including wage garnishment — against you.

Bankruptcy eliminates these deficiency debts. Don’t get stuck paying for a car or home you no longer own. Contact the McBride Law Firm today.
