Under Chapter 13, debts are reorganized into a repayment plan. Repayment plans typically last three to five years. During this time, individuals make monthly payments to the bankruptcy trustee. The trustee then disperses these payments among the individuals’ creditors. Creditors are typically paid pennies on the dollars owed. At the end of the repayment plan, any remaining debt is discharged.

Chapter 13 is typically used by individuals who earn too much money to qualify for Chapter 7 under the means test, or those who have assets—such as a home with equity or other nonexempt assets—that they want to keep.

Chapter 13 can also help individuals who have nondischargeable debts such as student loans and back child support. While certain debts can never be discharged, including them in the repayment plan prevents collection action – such as wage garnishment – and gives individuals the opportunity to catch up on late payments.
