Nondischargeable Debts

What Debts Are Not Eliminated By Bankruptcy?

During bankruptcy, not all debts are dischargeable. Debts that cannot be eliminated through bankruptcy include:

  • Student loan debt
  • Child support debt
  • Spousal support, or alimony, debt
  • Personal injury judgments
  • Certain government fines and penalties
  • Secured debts such as mortgages and car loans, if you wish to keep the property
  • Certain tax debts

If the vast majority of your debts are not dischargeable, Chapter 7 bankruptcy may not be the best solution. However, you may be able to restructure your nondischargeable debts under Chapter 13 and eliminate enough dischargeable debts so you can afford to continue paying on your nondischargeable debts.
